1. General Provisions
These Terms and Conditions (“Terms”) govern your use of the TMS.AM platform (“Platform”), operated by TMS AM LLC (“Company”, “we”, “us”), registered in the Republic of Armenia. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
The Platform provides an online marketplace connecting passengers with licensed transport carriers for the purpose of searching, comparing, and purchasing transport tickets.
2. Definitions
- Platform — the TMS.AM website and any related applications.
- User — any individual who registers on or uses the Platform.
- Carrier — a licensed transport company that lists trips and sells tickets through the Platform.
- Ticket — an electronic document confirming the right to travel on a specific trip, date, and time.
- Order — a confirmed booking placed by the User through the Platform.
3. Registration and Accounts
3.1. To purchase tickets, you must create an account by providing accurate and complete information including your name, email address, and phone number.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3.3. You must be at least 18 years of age to create an account. Minors may travel on tickets purchased by a parent or legal guardian.
3.4. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
4. Booking and Tickets
4.1. The Platform allows Users to search for available transport trips, compare prices from multiple Carriers, and purchase electronic tickets.
4.2. A booking is confirmed once payment is successfully processed. Upon confirmation, an electronic ticket with a unique QR code is issued to the User.
4.3. The User must present a valid e-ticket (QR code) at the time of boarding. The Carrier may refuse boarding if a valid ticket cannot be presented.
4.4. Ticket prices are set by the Carriers. The Platform displays the final price inclusive of all applicable fees. No additional booking fees are charged by the Platform.
4.5. Seat selection availability depends on the Carrier. Some trips may offer assigned seating, while others operate on a first-come, first-served basis.
5. Payments
5.1. Payments are processed through secure third-party payment processors. The Platform supports credit/debit cards, mobile wallets, and local Armenian payment methods as made available.
5.2. All prices are displayed in Armenian Dram (AMD) unless otherwise specified.
5.3. Payment is required at the time of booking. The Platform does not hold or reserve tickets without confirmed payment.
5.4. The Company does not store credit card details. All payment data is handled by PCI-compliant payment processors.
6. Cancellations and Refunds
6.1. Users may request a cancellation and refund through the Platform’s dashboard.
6.2. Refund eligibility depends on the Carrier’s cancellation policy and the time remaining before departure:
- More than 24 hours before departure: full refund.
- Between 2 and 24 hours before departure: partial refund (amount determined by the Carrier).
- Less than 2 hours before departure: no refund.
6.3. Refunds are processed to the original payment method within 5–10 business days.
6.4. If a Carrier cancels a trip, the User is entitled to a full refund regardless of the time of cancellation.
6.5. The Platform reserves the right to modify refund policies with prior notice.
7. Travel Insurance
7.1. The Platform may offer optional travel insurance at the time of booking.
7.2. Insurance is provided by third-party insurance partners. The terms, coverage, and claims process are governed by the insurance provider’s policy.
7.3. Insurance premiums are non-refundable once the trip has commenced.
8. Carrier Responsibilities
8.1. Carriers listed on the Platform are independent licensed transport operators. The Platform acts solely as an intermediary and is not the transport provider.
8.2. Carriers are responsible for the safe and timely operation of their services, vehicle condition, driver qualifications, and compliance with applicable transport regulations.
8.3. The Platform is not liable for delays, cancellations, accidents, loss of luggage, or any other issues arising from the Carrier’s service.
9. User Obligations
9.1. Users must provide accurate personal information when booking tickets.
9.2. Users must arrive at the departure point at the time specified on the ticket. The Carrier is not obligated to wait for late passengers.
9.3. Users must comply with the Carrier’s rules regarding luggage, conduct, and safety regulations.
9.4. Users must not use the Platform for any unlawful purpose, including but not limited to fraud, impersonation, or unauthorized access.
10. Intellectual Property
10.1. All content on the Platform — including but not limited to text, graphics, logos, software, and design — is the property of TMS AM LLC or its licensors and is protected by copyright and intellectual property laws.
10.2. Users may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent.
11. Privacy and Data Protection
11.1. The collection, use, and protection of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.
11.2. By using the Platform, you consent to the processing of your personal data in accordance with our Privacy Policy and applicable data protection legislation of the Republic of Armenia.
12. Limitation of Liability
12.1. The Platform is provided “as is” without warranties of any kind, express or implied.
12.2. To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform.
12.3. The Company’s total liability for any claim arising from the use of the Platform shall not exceed the amount paid by the User for the specific booking in question.
13. Modifications
13.1. The Company reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform with the revised effective date.
13.2. Continued use of the Platform after modifications constitutes acceptance of the updated Terms.
14. Governing Law and Disputes
14.1. These Terms are governed by and construed in accordance with the laws of the Republic of Armenia.
14.2. Any disputes arising from or relating to these Terms shall be resolved through negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the Republic of Armenia.
